These Terms of Service (“Terms”) govern your access to and use of the DERT website, products, services, and related online experiences operated by Luxury Vivar, trading as DERT™ (“DERT,” “we,” “us,” or “our”).

By accessing our website or placing an order, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, please do not use our website or purchase our products.

1. ABOUT DERT

DERT™ is a science-driven beauty and wellness lifestyle brand focused on future-focused innovation, clean beauty, biohacking-inspired concepts, intentional rituals, transformation, and ascension.

DERT products are offered directly to consumers through our online storefront.

DERT may use independent third-party manufacturers, product suppliers, fulfillment providers, shipping carriers, payment processors, and technology providers to manufacture, prepare, fulfill, and deliver orders.

2. ELIGIBILITY

You must be legally capable of entering into a binding agreement in your jurisdiction to purchase products from DERT.

By placing an order, you represent that the information you provide is accurate and that you are authorized to use the payment method associated with the purchase.

If you are purchasing on behalf of another person or entity, you represent that you have authority to do so.

3. OUR PRODUCTS

We make reasonable efforts to ensure that product descriptions, ingredients, photographs, pricing, availability, and other information presented on our website are accurate and current.

Product images are provided for illustrative purposes. Actual packaging, color, finish, labeling, or other visual characteristics may vary.

We reserve the right to modify, discontinue, replace, or update products at any time.

Where a product has specific directions, warnings, or usage instructions, customers should read and follow them carefully.

4. MADE-TO-ORDER & FULFILLMENT

Many DERT products are prepared specifically for customer orders through our fulfillment network.

DERT works with specialized manufacturing and fulfillment partners located in different regions, including the United States and Europe.

Depending on the product and destination, an order may be manufactured, packaged, processed, and shipped by a third-party fulfillment partner on behalf of DERT.

This means customers may receive products directly from the fulfillment facility best positioned to serve their destination rather than from the DERT business address.

The DERT business address is not a customer return warehouse or fulfillment center.

5. ORDERS

When you place an order through our website, you are submitting a request to purchase the products selected at the prices displayed at checkout.

After your order is submitted, you will receive an order confirmation.

An order confirmation confirms that we have received your order; it does not necessarily mean that the order has been accepted or dispatched.

We reserve the right to refuse, cancel, or limit an order where permitted by law, including where:

a product is unavailable;
there is an obvious pricing or listing error;
payment cannot be successfully processed;
shipping information is incomplete or inaccurate;
an order appears fraudulent or unauthorized; or
fulfilling the order would violate applicable law or our supplier or fulfillment requirements.

If we cancel an order after payment has been received, we will provide an appropriate refund where required.

6. PRICING & PAYMENT

All prices displayed on the website are subject to change without notice.

The price charged for your order will be the applicable price displayed at the time of checkout, subject to correction of obvious errors.

Payment must be successfully authorized before an order can enter fulfillment.

DERT uses third-party payment processors to process transactions. We do not generally receive or store your complete payment-card information.

You are responsible for providing accurate billing and payment information.

7. SHIPPING & DELIVERY

DERT uses a network of third-party fulfillment and shipping partners.

Estimated delivery times vary depending on the product, destination, fulfillment location, processing time, carrier, and shipping method.

Current estimated delivery windows are provided in our Shipping Policy.

Delivery estimates are not guaranteed delivery dates.

DERT is not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, customs processing, weather, public holidays, strikes, incorrect addresses, or other unforeseen circumstances.

Once an order has been dispatched, tracking information will be provided where available.

8. INTERNATIONAL ORDERS

DERT may sell and ship products to customers in multiple countries and regions.

International orders may be subject to customs duties, import taxes, VAT, brokerage fees, or other charges imposed by the destination country.

Unless expressly stated otherwise at checkout, such charges are the responsibility of the customer.

Customers are responsible for ensuring that products ordered are permitted to be imported into their destination jurisdiction.

Shipping availability may vary by product and destination because of regulatory, fulfillment, carrier, or product-specific restrictions.

9. RETURNS, REFUNDS & DAMAGED ORDERS

Our Return & Refund Policy forms part of these Terms.

Because certain DERT products are cosmetic or personal-care products and may be prepared specifically for individual orders, eligibility for returns may vary depending on the product, condition, and applicable law.

Nothing in our Return & Refund Policy is intended to remove or restrict mandatory consumer rights that apply in your jurisdiction.

If your order arrives damaged, defective, incorrect, or materially different from what you ordered, please contact dertsupport@gmail.com with your order information and appropriate photographs or documentation so that we can investigate and determine the appropriate resolution.

10. PRODUCT SAFETY & USE

DERT products should only be used according to their intended purpose, directions, warnings, and applicable product information.

Customers are responsible for reviewing ingredients and determining whether a product is appropriate for their individual circumstances.

If you experience irritation, sensitivity, or an adverse reaction, discontinue use and seek appropriate professional advice where necessary.

DERT products and website content are not intended to replace professional medical advice, diagnosis, or treatment.

Unless expressly stated and legally supported, DERT cosmetic and wellness products are not intended to diagnose, treat, cure, or prevent disease.

11. WELLNESS & BIOHACKING CONTENT

DERT may use concepts such as biohacking, optimization, transformation, wellness, technology, science, and ascension in connection with our brand philosophy and lifestyle content.

Such content is provided for general informational and lifestyle purposes and should not be interpreted as medical advice or a guarantee of a particular health outcome.

12. INTELLECTUAL PROPERTY

All DERT™ branding and original website content, including the DERT name, logos, crest, designs, graphics, photographs, written materials, product names, layouts, and other creative materials, are owned by or licensed to Luxury Vivar unless otherwise stated.

You may not reproduce, copy, modify, distribute, publish, sell, license, or commercially exploit DERT intellectual property without our prior written permission.

DERT™ represents a trademark claim. The ™ designation does not represent that the mark is federally registered.

13. USER CONTENT

If you submit reviews, photographs, testimonials, comments, or other content to DERT, you represent that you have the right to submit that content.

By submitting content, you grant DERT a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, and distribute that content for legitimate business, marketing, and promotional purposes, subject to applicable law.

We reserve the right to remove content that is unlawful, misleading, abusive, defamatory, infringing, or otherwise inappropriate.

14. THIRD-PARTY SERVICES

DERT relies on third-party services to operate portions of our business, including manufacturing, fulfillment, shipping, payment processing, ecommerce technology, analytics, and other operational services.

Our fulfillment partners may include Selfnamed, Blanka, Supliful, Productifi, or other providers selected for particular products or destinations.

These providers operate independently and may have their own terms and policies.

Their involvement does not create a separate purchasing relationship between the customer and those providers. Your purchase through the DERT website is made from DERT.

15. THIRD-PARTY LINKS

Our website may contain links to third-party websites, applications, social-media platforms, or services.

DERT does not control those external services and is not responsible for their content, availability, security, or privacy practices.

Your use of third-party services may be subject to their own terms and policies.

16. WEBSITE AVAILABILITY

We make reasonable efforts to keep our website accurate, secure, and available.

However, we do not guarantee that the website will always be uninterrupted, error-free, secure, or available.

Nothing in these Terms is intended to remove or restrict mandatory consumer protections.

20. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Luxury Vivar, DERT, and their respective service providers from claims, losses, liabilities, damages, and expenses arising from your unlawful use of the website, violation of these Terms, or infringement of the rights of another person or entity.

This provision does not apply to the extent that the applicable claim results from DERT's own unlawful conduct or from circumstances where indemnification cannot legally be required.

Nothing in these Terms is intended to deprive consumers of legal protections that cannot lawfully be waived.
